Based on Act No. 111/1994 Coll., on Road Transport, as amended, Act No. 266/1994 Coll., on Railways, as amended, and pursuant to the Decree of the Ministry of Transport and Communications No. 175/2000 Coll., on Transport Rules for Public Rail and Road Transport, as amended, (hereinafter referred to as the "Transport Regulations"):
Article. 1
General provisions
The contractual transport conditions apply to the regular transport of persons, luggage and live animals in public transport vehicles (hereinafter referred to as "public transport") in the territory of the city of Hradec Králové and the municipalities of Běleč n/O, Divec, Lochenice, Předměřice n/L, Stěžery, Stěžírky, Vysoká n/L and set the conditions for this transport.
On the basis of the concluded transport contract, the passenger is obliged to comply with the conditions of the transport regulations, these contractual transport conditions and the tariff.
The driver and other authorized person of the carrier, equipped with a control badge and card, is entitled to give instructions and orders to passengers to ensure their safety and to ensure the safety and fluency of transport.
Dopravní podnik města Hradce Králové, a.s. (hereinafter referred to as "DPmHK, a.s.") informs passengers about transport and its changes in public transport vehicles, by notice boards on stop signs, in the information centre and in advance ticket sales, according to their seriousness in the daily press.
In public transport vehicles, where the control buttons for opening the doors are marked, a self-service door opening system is installed. This system allows the doors to be opened at stops only when the passenger selects (presses a button). When transporting persons with reduced mobility or visually impaired persons, such doors shall be opened by the driver.
Article. 2
Establishment and performance of a contract for the carriage of passengers
The Transport Contract is concluded if the passenger exercises his/her right to transport from the travel document by boarding the vehicle with a valid travel document (in the case of SMS and check-in using the HOPON mobile application, only with the received SMS ticket or HOPON ticket).
The Transport Contract is also concluded by allowing the passenger to board the vehicle without a ticket and the fare is paid by the driver immediately after boarding the vehicle (does not apply to SMS tickets and HOPON tickets).
The Contract of Carriage is fulfilled by performing the transport in the agreed scope according to the concluded transport contract.
For transport on public transport lines, travel documents issued by DPmHK, a.s. and carriers involved in the VYDIS system are valid.
Article. 3
Travel document
1) The passenger is obliged to carry a valid travel document for the entire duration of the transport, which he/she presents to the authorized person during the inspection of travel documents.
2) A valid travel document is:
a) a paper ticket for a single journey, in the appropriate price and type, marked in the marking device according to the instructions on the ticket (mechanical depreciation),
b) a paper ticket from the driver's premises, in the corresponding price, type and date of use,
c) ZTP, ZTP-P, PTP, KPV card entitling to free transport,
d) a chip card with an electronic record of the relevant transferable or non-transferable season ticket,
e) a chip card with an electronic record of the payment of individual fares,
f) a VYDIS ticket, in the corresponding price, type and date of use,
g) an SMS ticket with a valid code on the passenger's mobile device,
h) Ticket of the HOPON mobile application,
i) a complaint letter replacing a travel document accepted into the complaint procedure, for the duration of the complaint procedure, but no longer than 5 working days from the date of issue of the complaint sheet.
3) The authorised person is entitled to collect an invalid travel document in cases where:
When the travel document :
a) is damaged in such a way that it does not show the data necessary to check the correctness of its use,
(b) the data on it do not correspond to reality or have been unlawfully altered,
c) is used by an unauthorized person,
d) is not the original,
(e) it is used without the required photograph.
The authorised person shall always confirm the withdrawal of the travel document in writing on the submitted record of the performed ticket inspection.
Article. 4
Payment of fares and surcharges
Fares and tariff conditions are set by the regulation of the City of Hradec Králové on the maximum prices of public transport fares in the city of Hradec Králové and in municipalities connected to transport.
The fare is paid via the relevant paper tickets, via electronic record on the chip card, SMS fares or fares via the HOPON mobile application.
A paper ticket for a single journey is valid if it is an original issued by DPmHK, a.s. and if only at a designated place on the ticket are marked with signs confirming the passenger's tariff check-in using a marking device, according to the instructions printed on the ticket, or if the ticket contains information about the payment of the fare for the relevant transport.
When boarding the vehicle, the passenger is obliged to immediately validate the ticket for a single ride at the nearest marking device. A ticket for a single ride on a night line can only be purchased from the driver, this is no longer marked in the vehicle.
Transport for dogs is free of charge.
In DPmHK, a.s. vehicles, it is possible to purchase a ticket for a single ride and transport according to the previous paragraphs in a supplementary sale from the driver for the price set by the public transport tariff. The passenger shall ask the driver to sell such a ticket immediately and without delay when boarding the vehicle. The driver sells the ticket only at the stop, which is no longer marked in the vehicle.
A passenger who, for serious reasons attributable to him/her, returns to DPmHK, a.s. an unused season ticket with a quarterly or longer period of validity, may be refunded on the basis of his/her written request only an aliquot part of the unused fare, calculated from the day following the day on which it was returned to DPmHK, a.s., including a handling fee of CZK 50. Other unused time and individual tickets are not refunded.
A replacement ticket is not provided free of charge for a lost, stolen or damaged paper ticket, this does not apply if the loss or damage was caused by DPmHK, a.s.
An adequate electronic record of time fares or money is transferred from a lost, stolen or non-functional chip card to a newly issued chip card after the requested blocking of the card.
The passenger is obliged to pay a surcharge to the fare in the amount of CZK 1500 and a fare in the amount of the individual fare set by the tariff for 1 zone. The reduced rates and conditions for imposing and collecting the surcharge shall be determined by Article 9.
Article. 5
Transport of prams and bicycles
A passenger may take a baby stroller into the vehicle with or without a child only with the driver's knowledge and, if occupied, only through the designated door. Passage of the stroller through the vehicle is not permitted. Only one stroller may be transported in the vehicle, the driver may exceptionally allow the carriage of additional strollers if the operating conditions on the line allow it. The stroller is transported in a dedicated area marked on the outside of the vehicle door with the stroller symbol. Passengers must always secure the stroller against spontaneous movement and be with it throughout the transport. The carriage of a baby stroller with or without a child is free of charge.
The transport of bicycles is allowed on all days under the same conditions as for prams, with priority being given to the carriage of a pram with a child.
Article. 6
Transport of persons with reduced mobility
and transport of wheelchair users
Passengers with reduced mobility shall have the right to a seat in the vehicle on seats reserved and marked for them. If their right to a seat is not clearly apparent for such persons, they shall prove their entitlement with an appropriate card. Another passenger who has occupied such a seat shall be obliged to make this seat available to a passenger with reduced mobility at his/her request.
DPmHK, a.s. will reserve and designate at least 6 seats for passengers with reduced mobility and orientation in public transport vehicles.
A passenger with reduced mobility shall be able to enter and exit the vehicle through all doors that are indicated for the boarding or egress of passengers.
DPmHK, a.s. will transport a passenger in a wheelchair if the technical design of the vehicle and its occupancy allow and if the passenger himself / herself provides assistance in loading and unloading the wheelchair, including securing the wheelchair against spontaneous movement during transport in the vehicle.
A passenger in a wheelchair may enter the vehicle only with the driver's consent and exit the vehicle with the driver's knowledge.
The passenger boards with a wheelchair through the door marked for boarding with a pram and places the wheelchair on the platform.
Article. 7
Relations between DPmHK,a.s. and passengers
1) Obligations of DPmHK, a.s. :
a) provide information on the timetable, tariff and published conditions of carriage at places designated for communication with the public,
b) publish substantial parts of the announced transport conditions and tariffs in a public transport vehicle,
c) ensure the sale of tickets for the duration of the provision of transport services to passengers,
d) maintain order, cleanliness and peace in the vehicle,
e) in vehicles equipped with the appropriate equipment, announce the name of the station at the latest when the vehicle stops at the station and announce the name of the next station at the latest when the vehicle leaves the station,
f) ensure that every third vehicle stops at the level of the stop sign when several vehicles are standing in the station at the same time,
g) ensure that each vehicle is re-stopped at the level of the stop sign if there is a person in a wheelchair or a person with a stick in the station.
2) Obligations of passengers :
a) comply with the Transport Regulations, contractual transport conditions and tariffs,
b) have a valid travel document with you throughout the transport, both for yourself and for any live animal transported with you, unless they are transported free of charge, and on request to show it to an authorized person of DPmHK, a.s.,
c) ensure that he/she boards the vehicle in time at the boarding stop, transfers at the correct stop and gets off at the destination stop,
d) use the equipment in the vehicle only for the purpose for which it is intended,
(e) free up a place reserved for persons with reduced mobility for such persons if they so request;
f) follow the instructions and orders of the authorized person aimed at ensuring the safety and fluency of traffic and the safety of passengers,
g) refrain from anything that could endanger the safety and fluency of transport, order in the vehicle, cleanliness of the vehicle and passengers, or cause disturbance to the carrier's employees in the performance of their duties, or cause damage to the carrier or passengers,
h) pay the fare and surcharge on the fare, if it is not presented by a valid travel document at the request of an authorized person, or identify personal data necessary to enforce the payment of the surcharge, if it does not pay on the spot,
(i) to pay a surcharge for failure to comply with the transport schedule or instructions and orders of the authorised person or for disturbing the peaceful carriage of passengers, or for soiling the vehicle or otherwise causing nuisance to passengers.
j) at the request of an authorized person to follow him to a suitable public administration workplace to establish his identity or at the call of an authorized person to remain in a suitable place until the arrival of a person authorized to establish the passenger's identity, if he fails to comply with the obligation referred to in letter h).
3) In particular, passengers are not allowed:
a) get on and off if the driver gives an audible or light signal "Do not board", "Do not get out" or "Stop",
(b) board a vehicle declared occupied by the driver;
c) board the vehicle with things that must not be baggage,
(d) stay in the area reserved for the driver and in the areas intended for entry and egress;
e) talk to the driver while driving, prevent the driver from a safe view from the vehicle,
f) leave luggage or live animals on the seats,
g) pollute the vehicle by consumption of food and beverages or other activities,
h) smoke in the vehicle,
i) behave excessively noisily in the vehicle (e.g. whistle, sing, play or reproduce music),
j) board a vehicle with roller skates,
k) bother passengers with inappropriately carried luggage (e.g. backpack on the back, etc.)
4) Children under 6 years of age can only be transported accompanied by a person over 10 years of age.
Article. 8
Conditions of carriage of baggage and live animals
Easily portable items carried by the passenger can be carried as hand luggage and can be placed in the vehicle under the passenger's seat. The passenger has the right to take hand luggage with him to the vehicle free of charge. It is the responsibility of the passenger to ensure the safe handling and supervision of this baggage.
As accompanied luggage it is possible to transport items that do not correspond to hand luggage and require placement in a specially designated place in the vehicle. It is the responsibility of the passenger to ensure the safe handling and supervision of this baggage. Accompanying baggage is not subject to payment of the tariff price. Skis, snowboards or other sports equipment and items that by their properties can cause damage, injury or contamination to passengers and vehicles are transported only in a protective case.
Baggage handling and stowage must not endanger other passengers and prevent them from fulfilling their tariff obligations.
Passengers may take small domestic and other animals with them into the vehicle, unless this is prevented by special regulations, if they are enclosed in boxes with an impermeable bottom and if their transport is not a nuisance to other passengers (e.g. if they smell). The transport of the box with animals is free of charge.
Passengers may only take a dog with them to the vehicle for transport without a box. He can only board with the driver's knowledge. The dog must wear a safe muzzle (does not apply to a guide dog), must be kept by passengers on a short leash throughout the transport and must not be transported on a seat. At times of increased transport demands, the driver may refuse to transport a dog without a box. The passenger is responsible for the behavior of the transported dog. A dog that is a nuisance to other passengers by its behavior may be excluded from transport. A dog that is a guide for a ZTP-P card holder cannot be excluded from transport or refused.
It is prohibited to transport:
a) explosive, poisonous, radioactive, volatile and corrosive goods, with the exception of portable steel cylinders with liquid household fuel gas with a total capacity not exceeding 10 kg, a container with fuel oil with a total capacity not exceeding 20 l and a battery filled with electrolyte, secured against short circuits with secured degassing holes, passengers intending to carry out the carriage of the above permitted goods, is obliged to report this transport to the driver before boarding the vehicle and, after obtaining consent, to place the transported item in the vehicle according to the driver's instructions; a maximum of two fuel gas cylinders or a maximum of two containers of fuel oil or a maximum of two charged batteries may be carried in the vehicle,
(b) loaded firearms;
c) items whose properties may cause damage or contamination to passengers and vehicles (e.g. skis and snowboards without protective cover, glazed windows and glass without a rigid packaging, etc.),
d) items that may cause infection or things that by their odor or repellent appearance may be a nuisance to passengers or drivers,
e) articles the total weight of which exceeds 50 kg,
f) articles whose dimensions are larger than 50 cm x 60 cm x 80 cm or objects longer than 300 cm or objects in the shape of a plate if they are larger than 100 cm x 150 cm.
Article. 9
Ticket inspection
1) The authorized person of DPmHK, a.s. shall present a control badge and, at the request of the passenger, a DPmHK, a.s. card when performing a ticket inspection. This obligation does not apply to the driver of the vehicle.
2) The driver of the vehicle and another authorized person of DPmHK, a.s. equipped with a control badge and a license is entitled to:
a) require the passenger to present a valid travel document,
b) exclude from carriage a passenger who, at the request of an authorised person, fails to present a valid travel document and fails to comply with the obligation to pay the fare and surcharge on the spot,
c) exclude a passenger from carriage or impose a surcharge on a passenger if, despite warnings, he does not comply with the transport rules, instructions and orders of an authorized person, pollutes the vehicle or disturbs the peaceful transport of passengers or otherwise bothers other passengers,
d) refuse to allow for carriage or exclude from carriage the baggage of a passenger or an animal transported with him, if they are an obstacle to safe and comfortable transport or endanger the health of passengers or if their transport is not allowed by transport conditions, in particular the occupancy of the vehicle,
e) require a passenger who has not presented a valid travel document to pay the fare and surcharge set by the tariff or require the passenger to present personal data necessary to enforce the payment of the surcharge,
f) invite a passenger who has not fulfilled the actions referred to in the previous letter e) to remain in a suitable place until the arrival of a person authorized to establish the passenger's identity or to follow him to a suitable public administration workplace to establish the passenger's identity,
g) in order to maintain the fluidity and safety of traffic, decide on the method of controlling tariff discipline, e.g. by directing boarding and egress through designated doors.
3) If a passenger endangers the driver of a vehicle or another authorized person of DPmHK, a.s. by breaching their obligations, it could be an offense under Act No. 250/2016 Coll., on liability for misdemeanors and proceedings about them.
4) A passenger who validates a paper ticket, pays an electronic fare or pays an SMS fare in the vehicle at the time of an already commenced performance of a ticket inspection shall be considered a passenger who, for reasons on his part, did not present a valid travel document.
5) The surcharge for driving without a valid travel document, for smoking in a vehicle, for the transport of prohibited items and objects, for gross contamination of the interior of the vehicle by a passenger, is set at CZK 1500.
6) In the event that the passenger pays a surcharge (imposed pursuant to paragraph 5, ) on the spot, i.e. at the time of resolving the breach of obligations arising to the passenger from the Transport Rules and contractual transport conditions, the person authorized by the carrier is entitled to impose a surcharge reduced to CZK 500.
7) In the event that the passenger pays a surcharge (imposed pursuant to paragraph 5, ) in cash within three working days following the date of discovery of the passenger's breach of obligations arising from the Transport Rules and the Contractual Transport Terms and Conditions in the tariff and ticketing department at the registered office of DPmHK, a.s ., the surcharge shall be reduced to CZK 500.
The reduction of the surcharge may not be applied in the event of the detection of an invalid travel document pursuant to Article 3, par. 3, lit. b,c,d).
8) In the event that the passenger subsequently proves in the tariff and ticket department at the registered office of DPmHK, a.s., within three working days following the day of discovering his/her journey without a valid travel document, that at the time of the inspection he/she had already purchased a valid non-transferable season ticket or was a holder of a card entitling him to free transport, the surcharge is reduced to CZK 50 CZK.
9) The surcharge for other above-mentioned breaches of the Transport Rules and contractual transport conditions is set uniformly in the amount of CZK 50.
10) The Chairman of the Board of Directors of the Company always decides on mitigating the harshness of the financial penalty resulting from the imposed surcharge, on the withdrawal from the imposed surcharge, on the withdrawal of the already commenced enforcement of the surcharge at all levels of proceedings.
Article. 10
Other provisions
Items found in public transport vehicles are stored at the registered office of DPmHK, a.s. at Pouchovská 153, Hradec Králové. Information about the findings is provided on tel.č. 495 089 234.

Article. 11
Final provisions
These contractual transport conditions are valid for the transport of passengers, luggage and live animals in public transport operated by DPmHK, a.s. from 1 January 2020.
An excerpt of a substantial part of the Contractual Transport Terms and Conditions for public transport vehicles in Hradec Králové and the public transport tariff are published in all public transport vehicles .
The full wording of the Contractual Transport Terms and Conditions for Transport in Public Transport Vehicles in Hradec Králové is available both at the registered office of DPmHK, a.s. and at the Public Transport Terminal, the Hradec Králové Infocentre and on the carrier's website – www.dpmhk.cz.
The contractual transport conditions valid from 1.6.2018 are cancelled.
