Article 1
General provisions<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t\t\t\t\t
  1. The contractual transport conditions apply to the regular transport of persons, luggage, and live animals in public transport vehicles (hereinafter referred to as \u201cpublic transport\u201d) in the territory of the city of Hradec Kr\u00e1lov\u00e9 and the connected municipalities of B\u011ble\u010d n\/O, Divec, Lochenice, P\u0159edm\u011b\u0159ice n\/L, St\u011b\u017eery, St\u011b\u017e\u00edrky, and Vysok\u00e1 n\/L, and establish the conditions for this transport.<\/li>
  2. On the basis of the concluded contract of carriage, the passenger is obliged to comply with the terms and conditions of the transport schedule, these contractual conditions of carriage and the tariff.<\/li>
  3. The driver and another authorized person of the carrier, equipped with an inspection badge and ID card, are authorized to give passengers instructions and commands to ensure their safety and to ensure the safety and smoothness of transport.<\/li>
  4. Dopravn\u00ed podnik m\u011bsta Hradce Kr\u00e1lov\u00e9, a.s. (hereinafter referred to as \u201cDPmHK\u201d) informs passengers about transport services and changes thereto in public transport vehicles, via notices on bus stop posts, at the information centre and in ticket presale offices, and, depending on the severity of the situation, in the daily press.<\/li>
  5. A self-service door opening system is installed on public transport vehicles where the door opening control buttons are clearly marked. This system allows the doors to be opened at stops only when the passenger selects (presses) the button. When transporting persons with reduced mobility or visual impairment, the driver shall open such doors.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

    Article 2
    \nFormation and performance of a contract for the carriage of passengers<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t
    1. The transport contract is concluded if the passenger exercises their right to transport by boarding the vehicle with a valid travel document (in the case of SMS, only with a received SMS ticket).<\/li>
    2. The contract of carriage is also concluded by allowing the passenger to board the vehicle without a ticket and the passenger pays the fare immediately after boarding the vehicle at the driver or at another check-in facility (e.g. payment by card and similar means of payment).<\/li>
    3. The contract of carriage is fulfilled by performing the carriage in the agreed scope according to the concluded contract of carriage.<\/li>
    4. For transport on public transport lines, travel documents issued by DPmHK and carriers integrated into the VYDIS system are valid.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

      \n\t\t\t\t
      \n\t\t\t\t\t

      Article 3
      \nTravel document<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
      \n\t\t\t\t
      \n\t\t\t\t\t\t\t\t\t
      1. The passenger is obliged to have a valid travel document with them for the entire duration of the transport, which they must upon
        presents travel documents for inspection to an authorized person.<\/li>
      2. A valid travel document is:
        a) a paper ticket for a single ride, of the corresponding price and type, provided it is an original issued by DPmHK and the characters confirming the tariff clearance of the passenger by means of a validating device (mechanical cancellation) are marked solely and exclusively in the designated place on the ticket in accordance with the instructions printed on the ticket,
        (b) a paper ticket from the driver's sales office, of the appropriate price, type and date of use,
        c) ZTP, ZTP-P, PTP, KPV card entitling to free transport,
        (d) a smart card with an electronic record of the data and price of the relevant transferable or non-transferable time ticket,
        (e) a smart card, smart tag, bank card, mobile phone or watch with a bank card with an electronic record of payment of a single fare or as an identifier for a passenger's prepaid time ticket of the appropriate price, type and date of use,
        (f) a VYDIS ticket of the appropriate price, type and date of use,
        g) SMS ticket with a valid code on the passenger's mobile device.<\/li>
      3. An authorized person is entitled to confiscate an invalid travel document in cases where the travel document:
        (a) it is damaged in such a way that the data necessary to check the correctness of its use are not visible,
        (b) the information on it does not correspond to the facts or has been unduly altered,
        (c) it is used by an unauthorised person,
        d) is not original.

        The authorised person shall always confirm the removal of the travel document in writing on the record of the transport inspection carried out.<\/p><\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

        Article 4
        \nPayment of fares and surcharges<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
        \n\t\t\t\t
        \n\t\t\t\t\t\t\t\t\t
        1. Fares and fare conditions are set by the Hradec Kr\u00e1lov\u00e9 City Ordinance on maximum public transport fares in the city of Hradec Kr\u00e1lov\u00e9 and in transport-connected municipalities.<\/li>
        2. The fare is paid using the appropriate paper tickets, through an electronic record on a smart card, bank card, mobile phone, or a watch with a bank card, or via an SMS ticket.<\/li>
        3. Passengers with a single paper ticket board through the front door and are required to validate their ticket immediately upon boarding in the stamping machine located at the driver.<\/li>
        4. On a night line, a ticket can only be purchased from the driver, it is no longer validated in any way inside the vehicle, and it is valid for a single ride. Valid standard time-subscription tickets (specified in Article 4 of the valid tariff) are accepted on night lines; it is no longer necessary to purchase a \u201enight\u201c ticket for these.<\/li>
        5. In DPmHK vehicles, it is also possible to purchase a short-term, time-limited transfer ticket or a 24-hour ticket from the driver via supplementary sales for cash at the fare price set by the public transport tariff. Passengers must request such a ticket from the driver immediately and without delay upon boarding the vehicle. The driver shall only sell the ticket while stopped at a bus\/tram stop, and the ticket is not subject to any further validation inside the vehicle. The validity of the ticket is stated directly on the ticket itself and is valid for the entire public transport network.<\/li>
        6. A passenger who, for serious reasons on their part, returns an unused time-based ticket with a validity period of a quarter of a year or longer to DPmHK may be refunded only an aliquot part of the unused fare upon a written application, calculated from the day following the day onWhich the application was submitted to DPmHK. A handling fee of CZK 50 is deducted when paid in cash. Money is not refunded for other unused time-based and single tickets.<\/li>
        7. A replacement paper ticket is not provided free of charge for a lost, stolen, or damaged paper ticket; this does not apply if the loss or damage was caused by DPmHK.<\/li>
        8. Following the requested blocking of a lost, stolen, or malfunctioning smart card, the corresponding electronic record of time-based tickets or money is transferred to the newly issued virtual card.<\/li>
        9. The passenger is obliged to pay a surcharge to the fare in the amount of CZK 2,000 and the fare in the amount of the single fare. To determine the fare for the surcharge, the fare paid by paper ticket according to the valid tariff is taken. The reduced rates and conditions for the imposition and collection of the surcharge are determined by Article 9.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

          Article 5
          \nTransport of prams and bicycles<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
          \n\t\t\t\t
          \n\t\t\t\t\t\t\t\t\t
          1. A passenger may bring a baby stroller with a child into the vehicle only with the driver's knowledge and if vehicle capacity permits, and only through the designated door. Moving the stroller through the vehicle is not permitted. Only one stroller may be transported in the vehicle; the driver may exceptionally permit the transport of additional strollers if operational conditions on the line allow. The stroller must be transported in the designated area marked on the outside of the vehicle door with a stroller symbol. The passenger must always secure the stroller against spontaneous movement and remain by it for the entire duration of the journey. The transport of a baby stroller with a child is free of charge.<\/li>
          2. Bicycles can be transported on all days and under the same conditions as pushchairs. Carriage of a pushchair with a child is preferred.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

            Article 6
            \nTransport of persons with reduced mobility and transport of persons in wheelchairs for disabilities<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
            \n\t\t\t\t
            \n\t\t\t\t\t\t\t\t\t
            1. Passengers with reduced mobility have the right to be seated in seats reserved and marked for them. If their entitlement to a seat is not clearly visible, they shall prove their entitlement by means of the appropriate identification. Another passenger who has occupied such a seat shall be obliged to make the seat available to the passenger with reduced mobility at his\/her request.<\/li>
            2. DPmHK will reserve and designate the required number of seats in public transport vehicles for passengers with reduced mobility and orientation.<\/li>
            3. A passenger with reduced mobility must be able to enter and exit the vehicle through all doors marked for passenger boarding or alighting.<\/li>
            4. DPmHK shall transport a passenger in a wheelchair, provided that the technical design and occupancy of the vehicle allow it, and that the passenger arranges for assistance with loading and unloading the wheelchair themselves, including securing the wheelchair against spontaneous movement during transport in the vehicle.<\/li>
            5. Wheelchair passengers may only enter the vehicle with the driver's consent and exit the vehicle with the driver's knowledge.<\/li>
            6. The passenger boards with the wheelchair through the door marked for wheelchair boarding and places the wheelchair on the platform.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

              Article 7
              \nRelations between DPmHK and passengers<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
              \n\t\t\t\t
              \n\t\t\t\t\t\t\t\t\t
              1. Duties of DPmHK
                (a) provide information on the timetable, fare and announced transport conditions at places intended for contact with the public,
                b) publish the essential parts of the announced conditions of carriage and tariff in the public transport vehicle,
                (c) ensure the sale of tickets during the period when transport services are provided to passengers,
                d) maintain order, cleanliness and peace in the vehicle,
                (e) in vehicles equipped with the appropriate equipment, announce the name of the station at the latest when the vehicle stops at the station and announce the name of the next station at the latest when the vehicle leaves the station,
                (f) ensure that every third vehicle at the level of the stop marker is brought to a standstill if more than one vehicle is stationary at the same time,
                (g) ensure that each vehicle is brought to a stop at the level of the stop sign when a person in a wheelchair or with a blind cane is in the station.

                <\/li>
              2. Passenger Obligations:
                a) comply with the transport rules, contractual transport conditions and tariff,
                b) to have a valid travel document with oneself for the entire duration of the transport, both for oneself and for any bicycle being transported, and to present it upon request to an authorized person of DPmHK,
                (c) to ensure that he\/she enters the vehicle on time at the boarding stop, transfers at the correct stop and gets off at the destination stop,
                (d) use the equipment in the vehicle only for the purpose for which it is intended,
                (e) to make a place reserved for persons with reduced mobility available to such persons if they request it,
                (f) obey the instructions and orders of the authorised person aimed at ensuring the safety and continuity of traffic and the safety of passengers,
                g) refrain from anything that could endanger the safety and continuity of transport, order in the vehicle, the cleanliness of the vehicle and passengers, or disturb the carrier's employees in the performance of their duties, or cause damage to the carrier or passengers,
                h) pay the surcharge (fine) if he\/she fails to produce a valid travel document when requested to do so by an authorised person, or to produce the personal data required to enforce payment of the surcharge and fare if he\/she fails to pay the penalty on the spot,
                (i) pay a surcharge for failure to comply with the timetable or the instructions and orders of the authorised person or for disturbing the quiet carriage of passengers or for soiling the vehicle or otherwise causing a nuisance to passengers,
                j) upon the request of an authorized person, to follow them to a suitable public administration workplace to ascertain identity, or upon the request of an authorized person, to remain at a suitable place until the arrival of a person authorized to ascertain the passenger's identity, should the passenger fail to fulfill the obligation set out in letter h).

                <\/li>
              3. In particular, passengers are not allowed to:
                (a) get on and off if the driver gives the audible or visual signal \u201cDo not get on\u201d, \u201cDo not get off\u201d or \u201dStop\u201d,
                (b) board a vehicle declared occupied by the driver,
                (c) board the vehicle with items that must not be part of the luggage,
                (d) staying in the driver's compartment and in areas designated for boarding and alighting,
                (e) talking to the driver while driving, preventing the driver from seeing the vehicle safely,
                (f) placing luggage or live animals on the seats,
                (g) pollute the vehicle by consuming food and drink or by other actions,
                (h) smoking in the vehicle,
                (i) behaving excessively noisily in the vehicle (e.g. whistling, singing, playing or reproducing music),
                j) board the vehicle with roller skates on,
                k) to annoy passengers with improperly carried luggage (e.g., a backpack on the back, etc.)

              4. Children under the age of 6 can only be transported when accompanied by a person over the age of 10.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

                Article 8
                \nConditions for the carriage of luggage and live animals<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
                \n\t\t\t\t
                \n\t\t\t\t\t\t\t\t\t
                1. Easily portable items that the passenger has with them and that can possibly be placed in the vehicle under the passenger's seat can be transported as hand luggage. The passenger has the right to take hand luggage into the vehicle free of charge. Ensuring the safe handling of this luggage and supervision
                  above it belongs to the passenger.<\/li>
                2. As luggage accompanying the passenger, items that do not correspond in size to hand luggage and require placement in a specially designated area in the vehicle may be transported. Ensuring the safe handling of this luggage and supervising it is the responsibility of the passenger. They are not subject to the payment of the luggage fare. Skis, snowboards, or other sports equipment and items which, due to their properties, may cause damage, injury, or contamination to passengers and the vehicle
                  They are transported only in protective packaging.<\/li>
                3. Handling and stowage of baggage must not endanger other passengers or prevent them from fulfilling their fare obligations.<\/li>
                4. Passengers may take small domestic and other animals into the vehicle, provided that special regulations do not prevent it, if they are enclosed in containers with a waterproof bottom, and if their transport is not a nuisance to other passengers (e.g., if they emit an odor). The transport of animal containers is free of charge.<\/li>
                5. Passengers are only allowed to take a dog with them in the vehicle for transport without a crate. He\/she may board with it only with the knowledge of the driver. The dog must be fitted with a secure muzzle (does not apply to a seeing-eye dog), must be kept on a short lead by the passenger at all times during the journey and must not be carried on a seat. In times of increased transport requirements, the driver may refuse to transport the dog without a carrier. The passenger is responsible for the behaviour of the dog being transported. A dog whose behaviour is a nuisance to other passengers may be excluded from carriage. A dog that is a guide dog of a disabled person's card holder cannot be excluded from carriage or refused carriage.<\/li>
                6. It is prohibited to transport:
                  a) explosive, toxic, radioactive, volatile, and corrosive items, with the exception of portable steel cylinders for household liquid fuel gas with a total capacity of no more than 10 kg, containers of heating diesel with a total capacity of no more than 20 l, and a storage battery filled with electrolyte, secured against short circuits with secured degassing vents; passengers intending to transport the above-mentioned permitted items are required to report this transport to the driver before boarding the vehicle and, upon obtaining consent, place the transported item in the vehicle according to the driver's instructions; it is permitted to transport a maximum of two cylinders of fuel gas, or a maximum of two containers of heating diesel, or a maximum of two filled storage batteries in the vehicle,
                  (b) loaded firearms,
                  c) items which by their nature may cause damage or contamination to passengers and the vehicle (e.g., skis and snowboards without a protective cover, glazed windows and glass without a rigid packaging, etc.),
                  (d) items that may cause infection or items that may cause a nuisance to passengers or the driver by their odour or repulsive appearance,
                  (e) items whose total weight exceeds 50 kg,
                  f) items whose dimensions are larger than 50 cm x 60 cm x 80 cm, or items longer than 300 cm, or plate-shaped items if they are larger than 100 cm x 150 cm.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

                  \n\t\t\t\t
                  \n\t\t\t\t\t

                  Article 9
                  \nTransport control<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
                  \n\t\t\t\t
                  \n\t\t\t\t\t\t\t\t\t
                  1. During the transport inspection, the authorized person of DPmHK shall prove their identity by presenting a transport document inspection declaration, or alternatively an inspection badge, and upon the passenger's request, also a DPmHK ID card. This obligation does not apply to the driver of the vehicle.<\/li>
                  2. The driver of the vehicle and another authorized person of DPmHK equipped with a control badge and ID card is authorized to:
                    a) require the passenger to produce a valid travel document,
                    b) exclude from carriage a passenger who, when requested by an authorised person, fails to present a valid travel document and fails to fulfil the obligation to pay the fare and surcharge on the spot,
                    (c) exclude a passenger from carriage or impose a surcharge on a passenger if, despite being warned, he or she fails to comply with the transport regulations, instructions and orders of the authorised person, pollutes the vehicle or by his or her behaviour disturbs the peaceful carriage of passengers or otherwise annoys other passengers,
                    (d) refuse to accept for carriage or exclude from carriage a passenger's luggage or an animal carried with it if they are an obstacle to safe and comfortable carriage or endanger the health of passengers or if the conditions of carriage, in particular the occupancy of the vehicle, do not permit their carriage,
                    (e) to order a passenger who has not presented a valid travel document to pay the fare and surcharge specified in the fare schedule or to require the passenger to provide the personal data necessary to enforce payment of the surcharge,
                    f) to call upon the passenger who has failed to perform the actions pursuant to the preceding letter e) to remain at a suitable place until the arrival of a person authorized to ascertain the identity of the passenger or to follow to a suitable workplace of the public administration to ascertain the identity of the passenger,
                    g) to maintain the continuity and safety of the operation, decide on the method of controlling fare discipline, e.g. by directing boarding and alighting through designated doors.
                    If a passenger endangers the driver of the vehicle or another authorized person by violating their duties.<\/li>
                  3. DPmHK, this could be an offense under the relevant Act No. 250\/2016 Coll.<\/li>
                  4. A passenger who stamps a paper ticket, makes an electronic fare payment or pays an SMS fare on board the vehicle at the time when the transport control has already begun shall be deemed to have failed to present a valid travel document for reasons attributable to the passenger.<\/li>
                  5. The surcharge for riding without a valid ticket, for smoking in the vehicle, for transporting prohibited items and objects, and for severely soiling the interior of the vehicle by a passenger is set at CZK 2,000.<\/li>
                  6. In the event that the passenger pays the surcharge (imposed pursuant to paragraph 5) on the spot, i.e., at the time of addressing the breach of obligations arising for the passenger from the transport regulations and contractual terms of carriage, the person authorized by the carrier is entitled to accept it at a reduced amount of CZK 1,000.<\/li>
                  7. Reduction of the surcharge (imposed pursuant to paragraph 5) to CZK 1,000 is also possible if paid within a period of three business days following the day on which the breach of obligations arising for the passenger from the transport regulations and contractual transport conditions was ascertained. The surcharge reduction cannot be applied in the event that an invalid travel document is ascertained pursuant to Article 3, paragraph 3, letters b, c, d).<\/li>
                  8. In the event that the passenger subsequently proves at the fare and ticket department at the DPmHK headquarters, within a period of three working days following the day of the detection of travel without a valid transport ticket, that at the time of the inspection they had already purchased a valid non-transferable time ticket or held a pass entitling them to free transport, the surcharge is reduced to CZK 50.<\/li>
                  9. The surcharge for other violations of the transport regulations and contractual transport conditions not specified above is set uniformly at CZK 50.<\/li>
                  10.
