CONTRACTUAL TRANSPORT CONDITIONS FOR CARRIAGE ON PUBLIC TRANSPORT VEHICLES PUBLIC TRANSPORT IN HRADEC KÁLOVÉ

Article 1
General provisions

  1. The contractual transport conditions apply to the regular transport of passengers, luggage and live animals in public transport vehicles (hereinafter referred to as “MHD”) in the territory of the city of Hradec Králové and the transport-connected municipalities of Běleč n/O, Divec, Lochenice, Předměřice n/L, Stěžery, Stěžírky, Vysoká n/L and set out the conditions for this transport.
  2. On the basis of the concluded contract of carriage, the passenger is obliged to comply with the terms and conditions of the transport schedule, these contractual conditions of carriage and the tariff.
  3. The driver and other authorised person of the carrier, equipped with a control badge and a licence, is authorised to give instructions and orders to passengers to ensure their safety and to ensure the safety and continuity of transport.
  4. The Transport Company of the City of Hradec Králové, a.s. (hereinafter referred to as “DPmHK, a.s.”) informs passengers about the transport and its changes in public transport vehicles, by means of signboards on bus stop markers, in the information centre and in the pre-sale of tickets, according to the severity in the daily press.
  5. A self-service door opening system is installed on public transport vehicles where the door opening control buttons are clearly marked. This system allows the doors to be opened at stops only when the passenger selects (presses) the button. When transporting persons with reduced mobility or visual impairment, the driver shall open such doors.

Article 2
Formation and performance of a contract for the carriage of passengers

  1. A transport contract is concluded if the passenger exercises his/her right to transport by boarding the vehicle with a valid travel document (for SMS and HOPON mobile app check-in) and with a received SMS ticket or HOPON ticket.
  2. The contract of carriage is also concluded by allowing the passenger to board the vehicle without a ticket and the passenger pays the fare immediately after boarding the vehicle at the driver or at another check-in facility (e.g. payment by card and similar means of payment).
  3. The contract of carriage is fulfilled by performing the carriage in the agreed scope according to the concluded contract of carriage.
  4. For transport on public transport lines, travel documents issued by DPmHK, a.s. and carriers involved in the VYDIS system are valid.

Article 3
Travel document

  1. The passenger is obliged to carry a valid travel document for the entire duration of the carriage, which he/she shall present to the authorised person when checking travel documents.
  2. A valid travel document is :
    a) a paper ticket for a single journey, in the appropriate price and type, if it is an original issued by DPmHK,a.s. and if the only and only marks confirming the passenger's fare clearance are marked on the ticket in the designated place using a marking device (mechanical deterioration) according to the instructions printed on the ticket,
    (b) a paper ticket from the driver's sales office, of the appropriate price, type and date of use,
    c) ZTP, ZTP-P, PTP, KPV card entitling to free transport,
    (d) a smart card with an electronic record of the data and price of the relevant transferable or non-transferable time ticket,
    (e) a smart card, smart tag, bank card, mobile phone or watch with a bank card with an electronic record of payment of a single fare or as an identifier for a passenger's prepaid time ticket of the appropriate price, type and date of use,
    (f) a VYDIS ticket of the appropriate price, type and date of use,
    g) SMS ticket with a valid code on the passenger's mobile device,
    h) HOPON mobile app ticket,
    (i) a complaint slip replacing the travel document accepted for the complaint procedure, for the duration of the complaint handling period indicated on the document.
  3. The authorised person is entitled to withdraw an invalid travel document in the following cases,
    when the travel document:
    (a) it is damaged in such a way that the data necessary to check the correctness of its use are not visible,
    (b) the information on it does not correspond to the facts or has been unduly altered,
    (c) it is used by an unauthorised person,
    (d) is not an original,
    (e) is used without the required photograph.

The authorised person shall always confirm the removal of the travel document in writing on the record of the transport inspection carried out.

Article 4
Payment of fares and surcharges

  1. Fares and fare conditions are set by the Hradec Králové City Ordinance on maximum public transport fares in the city of Hradec Králové and in transport-connected municipalities.
  2. Fares are paid via the relevant paper tickets, via an electronic record on a smart card, bank card, mobile phone or watch with a bank card, SMS fare or fare via the HOPON mobile app.
  3. Passengers with a paper ticket for a single journey board through the front door and are obliged to mark their ticket in the driver's ticketing device immediately upon boarding.
  4. On the night line, you can only buy a ticket from the driver; it is no longer marked on the vehicle and is valid for one journey. On night lines, valid prepaid basic time tickets are accepted; it is no longer necessary to buy a „night“ ticket for these.
  5. On DPmHK, a.s. vehicles, it is also possible to purchase a short-term time change ticket or a 24-hour ticket for cash at the driver's counter at a price set by the public transport tariff. The passenger shall ask the driver for the sale of such a ticket immediately and without delay when boarding the vehicle. The ticket will be sold by the driver only at the stop, and will not be marked in the vehicle. The validity of the ticket is indicated directly on the ticket and is valid for the entire public transport network.
  6. A passenger who, for serious reasons on his/her side, returns an unused time ticket with a quarterly or longer validity period to DPmHK, a.s. may be refunded only an aliquot part of the unused fare calculated from the day following the day on which the request was submitted to DPmHK, a.s. A handling fee of CZK 50 will be added if the payment is made in cash. No refunds will be made for other unused time and single tickets.
  7. A replacement ticket is not provided free of charge for a lost, stolen or damaged paper ticket; this does not apply if the loss or damage was caused by DPmHK, a.s.
  8. An adequate electronic record of the time fare or money is transferred from a lost, stolen or non-functioning chip card to a newly issued chip card after the card has been blocked as requested.
  9. The passenger is obliged to pay a fare surcharge of CZK 2,000 and the fare in the amount of the individual fare. For the purpose of determining the fare surcharge, the fare paid with a paper ticket according to the valid tariff shall be taken. The reduced rates and the conditions for the imposition and collection of the surcharge are set out in Article 9.

Article 5
Transport of prams and bicycles

  1. A passenger may only take a pushchair with a child into the vehicle with the knowledge of the driver and if the vehicle is occupied, only through the designated doors. Passage of the pushchair through the vehicle is not permitted. Only one pushchair may be carried in the vehicle; the driver may exceptionally allow the carriage of additional pushchairs if the traffic conditions on the line so permit. The pushchair shall be carried in a designated compartment marked with a pushchair symbol on the outside of the vehicle door. The passenger must always secure the pushchair against unintentional movement and remain with it at all times during the carriage. There is no charge for carrying a pushchair with a child.
  2. Bicycles can be transported on all days and under the same conditions as pushchairs. Carriage of a pushchair with a child is preferred.

Article 6
Transport of persons with reduced mobility and transport of persons in wheelchairs for disabilities

  1. Passengers with reduced mobility have the right to be seated in seats reserved and marked for them. If their entitlement to a seat is not clearly visible, they shall prove their entitlement by means of the appropriate identification. Another passenger who has occupied such a seat shall be obliged to make the seat available to the passenger with reduced mobility at his/her request.
  2. DPmHK, a.s. shall reserve and mark the required number of seats in public transport vehicles for passengers with reduced mobility and orientation.
  3. A passenger with reduced mobility must be able to enter and exit the vehicle through all doors marked for passenger boarding or alighting.
  4. DPmHK, a.s. will transport a passenger in a wheelchair if the technical design of the vehicle and its occupancy permits it and if the passenger himself provides assistance in loading and unloading the wheelchair, including securing the wheelchair against spontaneous movement during transport in the vehicle.
  5. Wheelchair passengers may only enter the vehicle with the driver's consent and exit the vehicle with the driver's knowledge.
  6. The passenger boards with the wheelchair through the door marked for wheelchair boarding and places the wheelchair on the platform.

Article 7
Relations between DPmHK, a.s. and passengers

  1. Obligations of DPmHK, a.s.:
    (a) provide information on the timetable, fare and announced transport conditions at places intended for contact with the public,
    b) publish the essential parts of the announced conditions of carriage and tariff in the public transport vehicle,
    (c) ensure the sale of tickets during the period when transport services are provided to passengers,
    d) maintain order, cleanliness and peace in the vehicle,
    (e) in vehicles equipped with the appropriate equipment, announce the name of the station at the latest when the vehicle stops at the station and announce the name of the next station at the latest when the vehicle leaves the station,
    (f) ensure that every third vehicle at the level of the stop marker is brought to a standstill if more than one vehicle is stationary at the same time,
    (g) ensure that each vehicle is brought to a stop at the level of the stop sign when a person in a wheelchair or with a blind cane is in the station.
  2. Passenger Obligations:
    a) comply with the transport rules, contractual transport conditions and tariff,
    b) to carry a valid travel document for themselves as well as for the bicycle they may be transporting with them at all times during the transport and to present it to an authorised person of DPmHK, a.s. upon request,
    (c) to ensure that he/she enters the vehicle on time at the boarding stop, transfers at the correct stop and gets off at the destination stop,
    (d) use the equipment in the vehicle only for the purpose for which it is intended,
    (e) to make a place reserved for persons with reduced mobility available to such persons if they request it,
    (f) obey the instructions and orders of the authorised person aimed at ensuring the safety and continuity of traffic and the safety of passengers,
    g) refrain from anything that could endanger the safety and continuity of transport, order in the vehicle, the cleanliness of the vehicle and passengers, or disturb the carrier's employees in the performance of their duties, or cause damage to the carrier or passengers,
    h) pay the surcharge (fine) if he/she fails to produce a valid travel document when requested to do so by an authorised person, or to produce the personal data required to enforce payment of the surcharge and fare if he/she fails to pay the penalty on the spot,
    (i) pay a surcharge for failure to comply with the timetable or the instructions and orders of the authorised person or for disturbing the quiet carriage of passengers or for soiling the vehicle or otherwise causing a nuisance to passengers,
    (j) at the request of the authorised person, follow the passenger to an appropriate public administration office for identification or, at the request of the authorised person, remain in an appropriate place until the arrival of the person authorised to identify the passenger, unless he or she complies with the obligation referred to in point (h).
  3. In particular, passengers are not allowed to:
    (a) get on and off if the driver gives the audible or visual signal “Do not get on”, “Do not get off” or ”Stop”,
    (b) board a vehicle declared occupied by the driver,
    (c) board the vehicle with items that must not be part of the luggage,
    (d) staying in the driver's compartment and in areas designated for boarding and alighting,
    (e) talking to the driver while driving, preventing the driver from seeing the vehicle safely,
    (f) placing luggage or live animals on the seats,
    (g) pollute the vehicle by consuming food and drink or by other actions,
    (h) smoking in the vehicle,
    (i) behaving excessively noisily in the vehicle (e.g. whistling, singing, playing or reproducing music),
    j) board the vehicle with roller skates on,
    k) bother passengers with improperly carried luggage (e.g. backpack, etc.).
  4. Children under the age of 6 can only be transported when accompanied by a person over the age of 10.

Article 8
Conditions for the carriage of luggage and live animals

  1. Carry-on luggage can be easily transported as hand luggage and can be placed under the passenger's seat in the vehicle. The passenger has the right to take hand luggage on board the vehicle free of charge. It is the passenger's responsibility to ensure the safe handling and supervision of such luggage.
  2. Items that do not correspond in size to hand luggage and need to be placed in a designated place in the vehicle can be carried as oversized luggage. The safe handling and supervision of such luggage shall be the responsibility of the passenger. Cabin baggage is not subject to payment of the fare. Skis, snowboards or other sporting equipment and items whose characteristics may cause damage, injury or contamination to passengers and the vehicle shall be transported only in protective packaging.
  3. Handling and stowage of baggage must not endanger other passengers or prevent them from fulfilling their fare obligations.
  4. Passengers are allowed to take small pets and other animals with them in the vehicle, provided that this is not prevented by special regulations, that they are enclosed in boxes with an impermeable bottom and that their carriage is not a nuisance to other passengers (e.g. if they smell). There is no charge for the carriage of the animal box.
  5. Passengers are only allowed to take a dog with them in the vehicle for transport without a crate. He/she may board with it only with the knowledge of the driver. The dog must be fitted with a secure muzzle (does not apply to a seeing-eye dog), must be kept on a short lead by the passenger at all times during the journey and must not be carried on a seat. In times of increased transport requirements, the driver may refuse to transport the dog without a carrier. The passenger is responsible for the behaviour of the dog being transported. A dog whose behaviour is a nuisance to other passengers may be excluded from carriage. A dog that is a guide dog of a disabled person's card holder cannot be excluded from carriage or refused carriage.
  6. It is forbidden to transport :
    (a) Explosive, toxic, radioactive, volatile and corrosive items, except for a portable steel cylinder of liquid household fuel gas with a total capacity of 10 kg or less, a container of heating oil with a total capacity of 20 litres or less and a battery filled with electrolyte, secured against short-circuiting with secured degassing holes, a passenger intending to carry the above-mentioned items authorised for carriage shall, before entering the vehicle, notify the driver of the carriage and, after obtaining consent, place the item to be carried in the vehicle in accordance with the driver's instructions; no more than two bottles of fuel gas or no more than two containers of fuel oil or no more than two filled accumulators may be carried in the vehicle,
    (b) loaded firearms,
    (c) items whose properties may cause damage or contamination to passengers and the vehicle (e.g. skis and snowboards without protective packaging, glazed windows and glass without a solid cover, etc.),
    (d) items which may cause infection or items which, by their odour or repulsive appearance, may be a nuisance to passengers or the driver,
    (e) items whose total weight exceeds 50 kg,
    (f) objects whose dimensions are greater than 50 cm x 60 cm x 80 cm or objects longer than 300 cm or objects in the shape of a plate if they are larger than 100 cm x 150 cm.

Article 9
Transport control

  1. When carrying out a transport inspection, the authorised person of DPmHK, a.s. shall present a declaration on the inspection of travel documents, or an inspection badge and, at the passenger's request, a DPmHK, a.s. card. This obligation does not apply to the driver of the vehicle.
  2. The driver of the vehicle and any other authorised person of DPmHK, a.s. equipped with an inspection badge and a licence is authorised to:
    a) require the passenger to produce a valid travel document,
    b) exclude from carriage a passenger who, when requested by an authorised person, fails to present a valid travel document and fails to fulfil the obligation to pay the fare and surcharge on the spot,
    (c) exclude a passenger from carriage or impose a surcharge on a passenger if, despite being warned, he or she fails to comply with the transport regulations, instructions and orders of the authorised person, pollutes the vehicle or by his or her behaviour disturbs the peaceful carriage of passengers or otherwise annoys other passengers,
    (d) refuse to accept for carriage or exclude from carriage a passenger's luggage or an animal carried with it if they are an obstacle to safe and comfortable carriage or endanger the health of passengers or if the conditions of carriage, in particular the occupancy of the vehicle, do not permit their carriage,
    (e) to order a passenger who has not presented a valid travel document to pay the fare and surcharge specified in the fare schedule or to require the passenger to provide the personal data necessary to enforce payment of the surcharge,
    (f) require a passenger who has not complied with the actions referred to in paragraph (e) above to remain in an appropriate place until the arrival of a person authorised to establish the passenger's identity or to follow him to an appropriate public administration office to establish the passenger's identity,
    g) to maintain the continuity and safety of the operation, decide on the method of controlling fare discipline, e.g. by directing boarding and alighting through designated doors.
  3. If a passenger endangers the driver of the vehicle or another authorised person of DPmHK, a.s. by violating his/her duties, this could be an offence under the relevant Act No. 250/2016 Coll.
  4. A passenger who stamps a paper ticket, makes an electronic fare payment or pays an SMS fare on board the vehicle at the time when the transport control has already begun shall be deemed to have failed to present a valid travel document for reasons attributable to the passenger.
  5. The surcharge for driving without a valid travel document, for smoking in the vehicle, for transporting prohibited goods and objects, and for grossly soiling the interior of the vehicle by a passenger is set at CZK 2,000.
  6. In case the passenger pays the surcharge (imposed according to paragraph 5) on the spot, i.e. at the time of solving the violation of the passenger's obligations arising from the transport regulations and contractual transport conditions, the person authorized by the carrier is entitled to accept it in a reduced amount of CZK 1,000.
  7. Reduction of the surcharge (imposed pursuant to paragraph 5) to CZK 1,000 is also possible if the surcharge is paid within three working days following the date of discovery of a breach of the passenger's obligations arising from the transport regulations and the contractual conditions of carriage. The reduction of the surcharge cannot be applied in the event of the discovery of an invalid travel document pursuant to Article 3, paragraph 3, points b, c, d).
  8. In the event that the passenger subsequently proves to the fare and ticket department at the headquarters of DPmHK, a.s., within three working days following the date of discovery of his/her travel without a valid travel document, that at the time of the inspection he/she had already purchased a valid non-transferable time ticket, or was the holder of a card entitling him/her to free transport, the surcharge is reduced to CZK 50.
  9. The surcharge for other breaches of the transport regulations and contractual transport conditions not specified above is set uniformly at CZK 50.
  10. The Chairman of the Board of Directors of the company shall always decide on the mitigation of the severity of the financial penalty resulting from the imposed surcharge, on the withdrawal from the imposed surcharge, on the withdrawal of the already commenced recovery of the surcharge in all stages of the proceedings.

Article 10
Other provisions

  1. Items found in public transport vehicles are stored at the headquarters of DPmHK, a.s. at Pouchovská 153, Hradec Králové. Information about the finds is provided by calling 495 089 111.
  2. Information about public transport is provided on the carrier's website www.dpmhk.cz, during a personal visit to the customer centre of DPmHK, a.s. ul. Pouchovská, at the Public Transport Terminal or by calling 495 089 271.

Article 11
Final provisions

  1. These contractual transport conditions are valid for the transport of passengers, luggage and live animals in public transport operated by DPmHK, a.s. from 1 January 2026.
  2. An excerpt of the essential part of the Contractual Conditions of Carriage on public transport vehicles in Hradec Králové and the public transport tariff is published in all public transport vehicles.
  3. The full text of the Contractual Conditions of Carriage for transport in public transport vehicles in Hradec Králové is available both at the headquarters of DPmHK, a.s. and at the Public Transport Terminal and on the carrier's website - www.dpmhk.cz.
  4. The contractual transport conditions applicable from 1 March 2024 are cancelled.
